We at Pinkaloo Technologies, LLC, a software company, are committed to protecting your privacy. This Mobile Application Software and Web App Privacy Policy explains our data processing practices and your options regarding the ways in which your personal data is used and is provided by Pinkaloo Technologies, LLC, a Delaware limited liability company with a registered address of 1679 S. Dupont Highway, Suite 100, Dover, Delaware 19901, in connection with our App and Web App, as defined herein. If you have requests concerning your personal information or any questions please contact us at moderngiving@pinkaloo.com.

 

If you have objections to the Privacy Policy, you should immediately discontinue use of the Web site and App offered by us or our customers.

  1. 1. Definitions

For purposes of this Privacy Policy references to “us,” “we,” and/or “our” mean Pinkaloo Technologies, LLC.

References to the “Mobile App” mean any and all software services offered by us, including but not limited to mobile applicable software, which may also be called the Pinkaloo App or a variation thereof based on a customer’s organizational name, available for purchase via the iTunes and Google Play stores.

References to “you,” and/or “User,” mean the User of the Mobile App or Web App.

References to the “Web App” mean such server software application in which our customers may run within their own Web sites.

 

  1. 2. Agreement to be Bound

The following Privacy Policy governs our and our customer’s collection and use of Users’ private information via the Mobile App and Web App. By accessing the Mobile App and Web App you represent that you have read and understand the Privacy Policy and that you agree to be bound by thereby.

This Privacy Policy may be additionally subject to our Mobile Application Software Terms of Use or any other agreement entered into between us.

  1. 3. Modifications and Changes to Privacy Policy

We may modify, add to, suspend or delete the Privacy Policy, in whole or in part, at our sole discretion at any time, with such modifications, additions or deletions being effective thirty (30) days following emailing of a notice to our registered Users. Your use and/or access of the Web site and/or App after modification, addition or deletion of the Privacy Policy shall be deemed to constitute acceptance by you of the modification, addition or deletion. 

  1. 4. The Information We Collect

We collect both personally-identifiable information and non-personally-identifiable information from our Users. This information may include your full name; email address; billing address; phone number; user name and password; mother’s maiden name or other, similar, security-related answers; and GPS coordinates or location-tracking information. While we may collect billing information, such as your credit or debit card number and bank account details we do not store such information and process it directly though our payment processors, who may have privacy policies that differ from our own. 

We may also purchase and store personal information about our Users from third-party service providers. Furthermore, to the extent that information is provided via a User’s integrated social media account, such information may be collected and stored.

We also collect non-personally-identifiable information, such as your IP address; general demographic information, such as age, income, and occupation; browser/software used to access the Mobile App and Web App; the Web sites you visit before/after using the Mobile App and Web App; type of device used to access the Mobile App and Web App; and the date and time of your use of the Mobile App and Web App.

  1. 5. Use of Your Information and Your Preferences

We may use your personally-identifiable information to personalize your User experience; to improve customer service; social media integration; to process transactions; to contact Users in order to respond to inquiries and/or to send them information and updates pertaining to a transaction; and to inform Users about features aligned with their use of the platform.

 

  1. 6. Do Not Track (DNT) Disclosure

 

Please note that while you may have the opportunity to opt-out of targeted advertising as discussed in the “How to Opt-Out” section above, and you may be able to control the use of cookies through your Web browser as described in the “Use of Cookies” section below, some Web browsers may also give you the ability to enable a “do not track” setting. This setting sends a special signal to the Web sites you encounter while Web browsing. This “do not track” signal is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with the “do not track” setting enabled still have the ability to accept cookies. We do not respond to Web browser “do not track” signals at this time. If we do so in the future, we will describe how we do so in this Privacy Policy.   1. 7. Disclosures of your Information

Your personal information may be used by us for the purposes provided for herein. We do not share your personally-identifiable information with anyone who is not an employee of our company or as required to provide the Mobile App and Web App. This may include sharing your information with Stripe, Apple Pay, PayPal, Plaid (Privacy Policy) or a similar payment processor for the purpose of processing transactions; our customers who provide a white-label or similar version of the App or Web site that you seek to use; and tools and other service providers for the purpose of improving our customer service and provision of the Mobile App and Web App. By utilizing the Mobile App and Web App, you consent to your personal information being shared with such third-parties and are encouraged to review the privacy policies of such third-parties as they may differ from our Privacy Policy.   
Furthermore, from time-to-time we may share non-personally-identifiable information with our affiliates and third-party providers for the purpose of customer and demographic insights and marketing.

 

  1. 8. Legal Disclaimer

In addition to the forgoing disclosures contained in Section 7, we reserve the right to disclose your personally-identifiable information as required by law and when believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms or policies or another agreement into which we have entered with you, or as otherwise required by law.

  1. 9. Other Web Sites and Apps

The Mobile App and Web App may contain links to other Web sites, apps or software, which are outside our control and are not covered by this Privacy Policy. If you access other Web sites, apps and/or software using the links provided, the operators of these Web sites and/or software may collect information from you, which will be used by them in accordance with their privacy policies, which may differ from ours. 

  1. 10. Cookies & Activity Tracking

To enhance your online experience, we may use "cookies" or similar technologies, such as activity tracking, app performance tracking, bug reporting, and personalized advertising. Cookies are text files placed in your computer's browser to store your preferences. Cookies do not contain personally identifiable information; however, once you choose to furnish a Web site with personally identifiable information, this information may be linked to the data stored in the cookie.

We use cookies to understand Web site, the Mobile App and Web App, and Internet usage and to improve or customize the content, offerings or advertisements on our Web site or App. For example, we may use cookies to personalize your experience at our Web site and App (e.g., to recognize you by name when you return to a Web site), save your password in password-protected areas, and enable you to use shopping carts on our site. We also may use cookies to help us offer you products, programs, or services that may be of interest to you and to deliver relevant advertising.

We, our third party service providers, advertisers or our partners also may use cookies to manage and measure the performance of advertisements displayed on or delivered by us and/or other networks or sites. This also helps us, our service providers and partners provide more relevant advertising. 

We, our third party service providers, advertisers and/or our partners may also use "Web beacons" or clear .gifs, or similar technologies, which are small pieces of code placed on a Web page, to monitor the behavior and collect data about the visitors viewing a Web page. For example, web beacons may be used to count the users who visit a Web page or to deliver a cookie to the browser of a visitor viewing that page.

You can change your privacy preferences regarding the use of cookies and similar technologies through your browser. You may set your browser to accept all cookies, block certain cookies, require your consent before a cookie is placed in your browser, or block all cookies. Blocking all cookies will affect your online experience and may prevent you from enjoying the full features offered by us. Please consult the "Help" section of your browser for more information.

  1. 11. Access to and/or Modification of Your Information

If you access or use the Mobile App and Web App and volunteer personally-identifiable information, you may modify, update or delete such information by sending us an email at moderngiving@pinkaloo.com. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. In addition, please be aware that your ability to opt out from receiving marketing and promotional materials does not change our right to contact you regarding your use of the Mobile App and Web App.

 

  1. 12. Privacy Protection for Children Using the Internet

Protecting children's privacy is important to us. For that reason, we do not collect or maintain information of those persons we actually know are under the age of thirteen (13) nor is any part of the Mobile App and Web App targeted to attract anyone under the age of thirteen (13). We request that all users of the Mobile App and Web App who are under the age of thirteen (13) not disclose or provide any personally-identifiable information. If we discover that a child under thirteen (13) has provided us with personally-identifiable information, we will delete that child's personally-identifiable information from our records.

  1. 13. Notice to Minors

In addition to protecting the privacy of children under age (13) we are committed to protect the privacy of minors. Though the Mobile App and Web App are not targeted to minors nor is it intended to be used by minors, if, for any reason a minor has shared information via our Web site or App said minor may request and obtain removal of such information by contacting us at moderngiving@pinkaloo.com. Although we offer deletion capability for the Mobile App and Web App, you should be aware that the removal of content may not ensure complete or comprehensive removal of that content or information posted through the Web App or Mobile App.

  1. 14. Data Security

We take reasonable steps to maintain the security of the personally-identifiable information that we collect, including utilizing data encryption, SSL technology, PCI scanning, and management-only access; however, no data transmission over the Internet can be guaranteed to be completely secure. Thus, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk. Please note that non-encrypted communication using email is not secure. Thus, we cannot guarantee data security in email communication and, therefore, recommend using physical mail for confidential information.

  1. 15. International Transfer

We operate globally so it is necessary to transfer your information internationally. In particular, your information will likely be transferred to and processed in the United States where many of our servers are located. The data protection and other laws of other countries may not be as comprehensive as those in your country. Please be assured that we take reasonable steps to ensure that your privacy is protected. By accessing the Web App or using the Mobile App you consent to your information being collected, used and transferred as set forth in this Privacy Policy.

From time-to-time, we may update this Privacy Policy. We will notify you about material changes in the way we treat personally-identifiable information by notifying registered Users via email. We encourage you to periodically check back and review this statement so that you always will know what information we collect, how we use it, and with whom we share it.
